释义 | 酷刑 To intentionally inflict severe pain or suffering on another: Crimes (Torture) Ordinance (Cap 427) s 3(1). Any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity: Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment 1984 art 1(1). It does not include pain or suffering arising only from, inherent in or incidental to lawful sanctions: art 1(1). The pain or suffering may be physical or mental and it is immaterial whether it is caused by an act or omission: s 3(3). Torture is outlawed in international law as an offence against human dignity and as a principle of jus cogens. The Convention grants states universal jurisdiction over perpetrators of torture, obliging them to make torture a crime and prosecute and punish those guilty of it. In Hong Kong, it is an offence for public official or person acting in an official capacity, whatever his nationality or citizenship, to commit the offence of torture: s 3(1). See also Jurisdiction. 蓄意使他人受到劇烈疼痛或痛苦:《刑事罪行(酷刑)條例》(第427章)第3(1)條。指任何有意使他人的肉體或精神受到劇烈疼痛或痛苦的行為,而其目的在於從該人或第三方獲得情報或供認、就該人或第三方作出的行為或懷疑已作出的行為予以懲處、或恐嚇或脅迫該人或第三方、或基於任何種類的歧視理由,而該等疼痛或痛苦是由公務人員或其他以公務人員身份行事的人致使、或唆使、或在同意或默許的情況下發生:《1984年禁止酷刑和其他殘忍、不人道或有辱人格的待遇或處罰公約》第1(1)條。酷刑並不包括僅從合法制裁固有或附帶產生的疼痛或痛苦:第 1(1)條。可以是肉體或精神上的疼痛或痛苦,至於是否由若干行為或不行為導致則不具關鍵性:第3(3)條。國際法禁止酷刑,並視為不利人類尊嚴的罪行,屬於強制性法則。此公約授予各國對觸犯酷刑的人有全球性的司法管轄權,使各國視酷刑為罪行及對此作出檢控及懲處。在香港,如以公務人員的身份行事的公務人員或人士(無論是何國籍或公民身分)犯酷刑,即屬犯罪:第3(1)條。另見 Jurisdiction。n. |
