Contracts (whether simple or in the form of a deed) recognised as being contrary to public policy include contracts which are: related to the commission of crime (Fores v Johnes (1820) 4 Esp 97); injurious to public life (Allen v Hearn (1785) 1 Term Rep 56); injurious to foreign relations (Foster v Driscoll [1929] 1 KB 470); purporting to oust the jurisdiction of the courts (Hyman v Hyman [1929] 601); prejudicial to the administration of justice (Herman v Jeuchner (1885) 15 QBD 561 (CA)); restraint of marriage (Anon (1589) Owen 34); restraint of trade (Esso Petroleum Co Ltd v Harper’s Garage (Stourport) Ltd [1968] AC 269) or immoral (Pearce v Brooks (1866) LR 1 Exch 213).
