| 释义 | 以遺贈抵銷遺贈 The rules of construction that apply where a testator makes a double legacy in his or her will to the one beneficiary as to whether the legacies are substitutional or cumulative (for example, where testator X left a $10,000 legacy to Y and then in the same will, another $10,000 legacy to Y). If the testator makes an express or implied indication that both legacies are payable or if the legacies are of different amounts or types or given for different reasons, both legacies are payable; but if the legacies are of the same amount and the testator’s intention cannot be ascertained from the will, there is a presumption that only one legacy is payable: Hurst v Beach (1820) 5 Madd 351, 56 ER 929.
