| 释义 | 替代送達 A method of serving documents. In civil procedure when the rules of the court require a document to be served personally or by post and it is impracticable for any reason to serve the document in the manner prescribed, an application may be made to the court for substituted service of the document. An application for an order of substituted service may be made ex parte by affidavit stating the facts on which the application is founded. The court may order substituted service to take place in whatever way it deems reasonable to bring the document to the notice of the person to be served: The Rules of the High Court (Cap 4A) O 65 r 4; Alpha Star Enterprises Ltd v Personal Representative of Tang Mei Shin (dec’d) [2002] 4 HKC 218. Substituted service may take the form of service by post addressed to the person to be served at a specified address, or by service on some other person, or by advertisement in a newspaper: Chan Yeuk Mui v Ng Shu Chi [1999] 2 HKC 702, 2 HKLRD 376.
