Account payee |
Words written on the face of a cheque putting a bank on inquiry if the cheque is not paid into the payee's account, even if the cheque appears to be regularly indorsed. Such crossing does not prevent a cheque from being negotiable or transferable: National Bank v Silke [1891] 1 QB 435. In Hong Kong the words were held to be no more than a direction to the collecting bank to credit the moneys once received to the account of the payee: Wayfoong Credit Ltd v Remoco (HK) Ltd [1983] 2 HKC 445 (HC). The word ‘only’ was emphatic rather restrictive: Edward Wong Financial Co Ltd v Infinity Industrial Co Ltd & Anor [1977-1979] HKC 449 (HC). Recently the words ‘account payee only’ were held to be no more than a warning to the collecting bank to exercise the reasonable care of a prudent banker to satisfy himself that the named payee had authorised collection for the indorsee: HongKong Chinese Bank Ltd v Delon Photo & Hi-Fi Centre Ltd [2000] 3 HKC 71 (CFI). See also Cheque; Crossing; Not negotiable. 另見 Cheque; Crossing; Not negotiable。 |
