A solemn act of the Chief Executive either absolutely or conditionally forgave or remitted, for the benefit of the person to whom it was granted, the legal consequences of a crime that person had committed, which included a remission of sentence: Basic Law art 48(12); Criminal Procedure Ordinance (Cap 221) s 118; R v Sze Tak Hung [1991] 1 HKLR 109. At common law, a pardon may not be given in advance for an act which has not been committed: Phillip v DPP of Trinidad and Tobago [1992] 1 AC 545, 1 All ER 665, 2 WLR 211 (PC). A magistrate or a judge of the Court of First Instance may, with the consent in writing of the Secretary for Justice, grant a conditional pardon to a person accused or suspected of a crime: Criminal Procedure Ordinance (Cap 221) s 115.
