释义 | 可予強迫 The state of being able to be made or being lawfully required to give evidence. As a general rule witnesses who are competent to testify are also compellable: Hoskyn v Metropolitan Police Cmr [1979] AC 474, 67 Cr App Rep 88 (HL). A defendant is not compellable to give evidence for or against himself: Evidence Ordinance (Cap 8) s 10. A person is not compellable to answer any question tending to criminate himself: s 10. A person in any legal proceedings other than criminal proceedings has a right to refuse to answer any question or produce any document or thing of to do so would tend to expose that person to proceedings for an offence or for the recovery of a penalty: s 65(1). Persons under diplomatic or consular immunity are competent but not compellable as witnesses: R v Nowaz [1976] 1 WLR 830.
