| 释义 | 選擇次序 An advantage gained by a creditor over the other creditors of a person who subsequently becomes bankrupt. The advantage must result from the debtor transferring property, giving security, undertaking an obligation, or making a payment to the preferred creditor at a time when the debtor was insolvent. Any conveyance, mortgage, delivery of goods, payment, execution or other act relating to property made or done by or against a company within six months before the commencement of its winding up which, had it been made or done by or against an individual within six months before the presentation of a bankruptcy petition on which he is alleged bankrupt, would be deemed in his bankruptcy a fraudulent preference, shall in the event of the company being wound up be invalid: Companies Ordinance (Cap 32) s 266(1).
