释义 | 合約委托保管 1. The delivery of personal property or goods by one person (the bailor) to another (the bailee) who holds them in trust for some specific purpose or object upon the basis of a contract between them, either express or implied. After the purpose has been fulfilled, the property is returned to the bailor or otherwise dealt with by the bailee according to appropriate instructions, or retained until it is reclaimed, as the case may be. 2. The bailor/bailee relationship imposes special duties and obligations on the person who takes possession of the bailor’s goods: Pawnbrokers Ordinance (Cap 166) s 22. See also Bailment; Lease. 1.一方(委托保管人)將個人財產交付予另一方(受托保管人),受托保管人根據其與委托保管人之間的合約(不論明訂或默示)而以信托形式持有該個人財產,用以履行某特定用途或目的。在履行該用途以後,視屬何情況而定,該財產將歸還予委托保管人,或由受托保管人按照相關的指示處理該財產。 2. 基於委托保管人與受托保管人之間的關係,接管委托保管人的物品的人士獲委以特別職責和責任:《當押商條例》(第166章)第22條。另見 Bailment; Lease。 |
