| 释义 | 出示業權契據的契諾 A covenant commonly included in conveyances or mortgages of land that the vendor or mortgagor will produce to the purchaser or mortgagee certain of the title deeds to the property. The covenant runs with the land, so as to be enforceable by successors in title to the purchaser or mortgagee. Where there is an express covenant to produce (a legal covenant), an equitable right to the production of title deeds arises where the ownership of land held under a single title is divided and the title deeds remain in the possession of the owners of a part. The owners of the rest have an equitable right to enforce production of the deeds in order to defend their title or to deal with their land: Fain v Ayers (1826) 2 Sim & St 533, 57 ER 450. Attested or certified copy of the title deeds are acceptable in Hong Kong to prove title: Conveyancing and Property Ordinance (Cap 219) s 13(2). 一般載於土地轉讓證書或按揭中的契諾，規定賣方或按揭人須向買方或承按人出示物業的若干業權契據。該契諾隨土地轉移，因此可由業權繼承人向買方或承按人強制執行。凡有明訂的出示業權契據的契諾（即法定契諾），當根據某一業權而持有的土地所有權被攤分，及某一部分的所有人仍管有業權契據，則產生衡平法上的出示業權契據的權利。其餘部分的所有人均有衡平法上的權利強制執行出示業權契據，以保障其業權或處理其土地：Fain v Ayers (1826) 2 Sim & St 533, 57 ER 450。經核簽證實為業權契據的真正副本或經核證為業權契據的真正副本，在香港可承認為業權的證明：《物業轉易及財產條例》（第219章）第13(2)條。 |
