释义	依賴 The adoption of some action or inaction pursuant to a state of affairs that is assumed to be true upon a representation, promise or assurance made by another. Where a defendant makes a statement which is reasonably relied upon by a plaintiff (who may even be a third party), in the way intended by the defendant, with the resultant damage to the plaintiff, there may be an expressed or implied assumption of responsibility sufficient to give rise to liability for economic loss flowing from the reliance: Yue Xiu Finance Company Limited v Agnew [1996] 2 HKC 122, 1 HKLR 137 (CA). The plaintiff’s reliance on the statement must be reasonable in order to give rise to a duty: Yuen Kun Yeu v A-G [1988] AC 175, [1987] 2 HKC 25 (PC). The nature of the relationship between the parties, for example its commercial context (Mutual Life and Citizens’ Assurance Co Ltd v Evatt [1971] AC 793, 1 All ER 150 (PC)) or informal nature (Howard Marine and Dredging Co Ltd v A Ogden & Sons (Excavations) Ltd [1978] QB 574, 2 All ER 1134 (CA)), may suggest that reliance is not reasonable. Where the plaintiff’s reliance on a negligent statement leads to foreseeable physical damage, the defendant will be liable provided that there is sufficient proximity and that the imposition of a duty would be fair and reasonable: Marc Rich & Co AG v Bishop Rock Marine Co Ltd [1996] 1 AC 211, sub nom Marc Rich & Co AG v Bishop Rock Marine Co Ltd, The Nicholas H [1995] 3 All ER 307 (HL).
