释义 | 撤銷要約 A withdrawal or termination of an offer so that it can no longer be accepted. Generally, an offer may be revoked at any time before it has been accepted: Financings Ltd v Stimson [1962] 3 All ER 386, 1 WLR 1184 (CA). This is so even though the offeror has indicated that he will keep his offer open for a specified time: Cooke v Oxley (1790) 3 Term Rep 653. An offer will be revoked where the offeror (or his agent or any reliable third person) communicates to the offeree, in any manner (Re Brewery Assets Corp, Truman’s Case [1894] 3 Ch 272), his unequivocal (Manchester Diocesan Council for Education v Commercial and General Investments Ltd [1969] 3 All ER 1593, [1970] 1 WLR 241) intention to revoke the offer either expressly (Henthorn v Fraser [1892] 2 Ch 27 (CA)) or impliedly (Cartwright v Hoogstoel (1911) 105 LT 628). There is no ‘postal revocation rule’: Byrne & Co v Van Tienhoven (1880) 5 CPD 344. The so-called ‘unilateral contracts’ may not be revocable once an offeree has performed some of the acts.
