释义 | 雙重犯罪 In extradition proceeding, a requirement that the conduct, which is the subject of the charge in respect of which the proceedings are brought, be an offence in both jurisdictions. A person shall not be surrendered to a prescribed place unless an offence by a person against the law of a prescribed place is a relevant offence in Hong Kong: Fugitive Offenders Ordinance (Cap 503) s 5(2)(b), (c). ‘Relevant offence’ is defined as the offence which is punishable under the law of Hong Kong with imprisonment for more than 12 months or any greater punishment and the conduct if occurrence of which in Hong Kong would constitute an offence specified in the Fugitive Offenders Ordinance (Cap 503) sch 1 and punishable in Hong Kong with imprisonment for more than 12 months or any greater punishment: Fugitive Offenders Ordinance (Cap 503) s 2(2).
