释义 | 違憲 A legislative, judicial or executive act that is not authorised by the constitution. The effect of a court declaring certain provisions of a piece of legislation unconstitutional is that those provisions are null and void and have no legal effect. In the absence of any provision in the Basic Law or another law as to the effect of such declaration, the court does not repeal the unconstitutional parts and has no power to do so; it simply ‘blue-pencils’ them: Lau Kong Yung v Director of Immigration [1999] 3 HKLR 778. The result of the court declaration is that the Government cannot rely on or enforce those unconstitutional provisions. An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is, in legal contemplation, as inoperative as though it had never been passed: Lau Kong Yung v Director of Immigration, supra.
