| 释义 | 合法殺人 A homicide not subject to criminal prosecution. A justifiable homicide carried with it condemnation rather than blame and accordingly entitled the accused to total acquittal, entailing no forfeiture and requiring no pardon, to be contrasted with excusable homicide. A justifiable homicide may occur where the execution of a prisoner in strict conformity with the sentence of a court or the use of a reasonable force in prevention of crime (R v Duffy [1967] 1 QB 63, 50 Cr App R 68 (CCA)) or self defence (Palmer v R [1971] AC 814, 1 All ER 1077). In Hong Kong, the old category of justifiable homicide appears, for all practical purposes, to have been merged by the Offences Against the Person Ordinance (Cap 212) s 8 which provides that no punishment will be incurred by any person who kills another by misfortune; or in his own defence, or lawfully in any other manner: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.313].
