释义 | 中立 The situation of a state which is unaligned. Foreign relations - The legal status of neutrality terminates when a neutral state takes part in hostilities, unless the resort to force is aimed at preserving neutrality: International Convention respecting the Rights and Duties of Neutral Powers and Persons in case of War on Land 1907 art 10. A policy of neutrality may be declared and terminated unilaterally by the state concerned. International law does not oblige a state to remain neutral, but a state has a right to neutrality pursuant to the principle of sovereign equality: Charter of the United Nations 1945 arts 48, 50. See also Neutral state. Insurance - An express warranty in relation to insurance property, whether ship or goods. It is an implied condition that the property has a neutral character at the commencement of the risk and that its neutral character will be preserved during the risk, for example, in time of war: Marine Insurance Ordinance (Cap 329) s 36(1). It is also an implied condition that the ship will be properly documented to establish neutrality: Halsbury’s Laws of Hong Kong, Vol 15, Insurance [220.489]-[220.490]. If any loss occurs through breach of this condition, the insurer may avoid the contract: Marine Insurance Ordinance (Cap 329) s 36(2).
