释义 | 名義次承建商 In building law, a subcontractor imposed upon a contractor by the employer, pursuant to the main contract. The employer may direct the contractor to enter a subcontract with the nominated person for particular work. Despite the employer’s nomination, there is no privity of contract between employer and nominated subcontractor: A Vigers Sons & Co Ltd v Swindell [1939] 3 All ER 590. Except pursuant to express provision, the contractor remains totally responsible for all nominated subcontract work, including design of the nominated subcontractor, according to its contract with the employer (Independent Broadcasting Authority v EMI Electronics Ltd (1980) 14 BLR 1), and there is no cause of action against the employer in respect of any delay extensively with the establishment, administration and effect of the nomination process.
