In any family law proceeding concerning a child, the court must regard the welfare of the minor as the first and paramount consideration: Guardianship of Minors Ordinance (Cap 13) s 3(1)(a)(i). This means that everything and everyone else involved in such cases (including the parents) is secondary to that objective. However, this does not apply in ouster proceedings: Richards v Richards [1984] AC 174, 5 FLR 11, [1983] 3 WLR 173, 2 All ER 807 (HL). The welfare of the minor is the paramount consideration, but not the sole consideration, factors such as the wishes of the natural parents; the wishes of the minor; information provided by the Director of Social Welfare; the conduct of the parents; the physical, emotional, educational and other needs of the child; maintaining the status quo, the desirability for siblings to stay together; and the desirability for children of tender years to stay with their mother, may also affect the court’s decision: Halsbury’s Laws of Hong Kong, Vol 12, Family Law [180.329].
