Criminal law - A person charged of criminal conduct will be dealt with according to law: Criminal Procedure Ordinance (Cap 221) s 101(5). Arrested persons who are detained in custody must be taken before a magistrate as soon as practicable: Police Force Ordinance (Cap 232) s 52(1); Criminal Procedure Ordinance (Cap 221) s 101(5). Each information should contain only one charge: Magistrate Ordinance (Cap 227) s 10(2). Where a defendant is present at the hearing, the defendant may be required to enter a plea: Magistrates Ordinance (Cap 227) s 8. Family law - Generally, a duty or obligation, such as the care and control of a child.
Real property - A mortgage expressed to be a legal charge: Conveyancing and Property (Cap 219) s 2. It is a security for a debt or obligation attaching to property of a debtor. A mortgage of a real property, including any second or subsequent mortgage of the same, may be effected at law only by a charge by deed expressed to be a legal charge: s 44(2). A charge may be fixed on a specific property, or it may float over all property, or property of a certain type, crystallising on exercise of the chargee’s rights under the charge. A charge over land or company property gives the chargee certain rights under the charge. A charge over land or company property gives the chargee certain rights to take possession of, or receive payment out of the proceeds of sale of, the charged property: ss 44, 51, sch 4.
