| 释义 | 中國舊式婚姻 A marriage which was celebrated in accordance with the traditions, customs, rites and ceremonies accepted at the time of the marriage as appropriate for the celebration of the marriage either in the part of Hong Kong where the marriage took place or in the place recognised by the family of either party to the marriage as their family place of origin, and is an alliance of the families of the respective parties: Kwan Chui Kwok Ying v Tao Wai Chun [1995] 1 HKC 374. Expert witnesses have frequently been called to ascertain the relevant Chinese law and custom even though that law and custom is part of the law of Hong Kong: Yau Tin Sung v Yau Wan Loi [1983] 2 HKC 647, [1984] HKLR 15; Yeung Chi Ding v Yeung Tse Chun [1986] HKLR 131. Chinese customary marriages have been recognised as valid under the law of Hong Kong and the term has received a statutory definition. Such marriages celebrated before 7 October 1971 are declared to be valid: Marriage Reform Ordinance (Cap 178) s 7; Ng Ching Man v Ng Lai Wah [1996] 4 HKC 448; Chong Chui Yuk Ching v Chong Pui Cheong [1983] 1 HKC 544, HKDCLR 1.
