释义 | 或有的條件 In contract law, an event which may or may not occur and that neither party undertakes to bring about, but on whose occurrence depends the creation or subsistence of a contract. A contingent condition is precedent if it provides that the contract is not to be binding until the specified event occurs: Port Jackson Stevedoring Pty Ltd v Salmond & Spraggon (Aust) Pty Ltd (1978) 139 CLR 231. A condition is subsequent if it provides that a previously binding contract is to determine on the occurrence of an event.
