| 释义 | 公眾權利 A common right enjoyed by all the Government’s subjects, irrespective of any interest they may have in a tenement: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0523]. An example is right of way: St Edmundsbury and Ipswich Diocesan Board of Finance v Clark (No 2) [1975] 1 All ER 772, 1 WLR 468 (CA). A public right may exist at either common law or as a result of statute (for example, Road (Works, Use and Compensation) Ordinance (Cap 370) s 15). In the case of roads, a public right may be evidenced by public use of the road without any element of licence, compulsion, or secrecy: Jones v Bates [1938] 2 All ER 237.
