In patent law, to make available to public (whether in Hong Kong or elsewhere) and a document shall be taken to be published if it can be inspected as of right at any place in Hong Kong by members of the public, whether on payment of a fee or not: Patents Ordinance (Cap 514) s 5. In relation to a work, the issue or making available of copies of the work to the public: Copyright Ordinance (Cap 528) s 196(1). In relation to sound recording, ‘publish’ is within the meaning of ‘release’. 2. To print, exhibit, distribute, post up, publicly announce or make publicly known by any other means, and includes continue to publish: Elections (Corrupt and Illegal Conduct) Ordinance (Cap 554) s 2(1). It includes issue, circulate, display, distribute or broadcast: Education Ordinance (Cap 279) ss 86A, 86B, Travel Agents Ordinance (Cap 218) s 47(4). 3. In relation to prospectuses, to publish or cause to be published by way of advertisement in accordance with such form and manner of publication as may have been specified by the Securities and Futures Commission, any extract from or abridged version of a prospectus in relation to shares or debentures of a company whether incorporated in or outside Hong Kong, and publish the English version only of a prospectus in an English language newspaper or the Chinese version only in a Chinese language newspaper: Companies Ordinance (Cap 32) s 38B. In relation to a notice, to publish in the Gazette (ss 103, 228A(11), 253); or to publish both in the English language newspaper and the Chinese language newspaper and in the Gazette (s 71A(3)); or to publish in the Gazette and send the notice by post to the company (ss 291, 360C).
