Lat – recognitio – acknowledgment. An acknowledgment by a person that the person is indebted to the state for a certain sum of money where the debt is extinguished on a certain happening, for example where the person appears in court or has for a certain period been of good behaviour: Re Nottingham Corp [1897] 2 QB 502. A recognisance can be used to bind witness to appear in court: Criminal Procedure Ordinance (Cap 221) s 38(1). A recognisance may be used in some circumstances to ensure that an appeal is duly prosecuted: Magistrates Ordinance (Cap 227) s 110. It may also be used to ensure that a person is of good behaviour for a set period or keeps the peace: Criminal Procedure Ordinance (Cap 221) s 109I; Magistrates Ordinance (Cap 227) s 61. Where a recognisance is breached the court can order it be forfeited and the person becomes liable to pay the sum acknowledged: Criminal Procedure Ordinance (Cap 221) s 111; Magistrates Ordinance (Cap 227) s 65. Where the recognisance follows the conviction for an offence where sentence has been deferred, a breach of the recognisance can result in the person being sentence for the offence: Criminal Procedure Ordinance (Cap 221) s 107.
