释义 | Shelley一案的規則 A rule affecting words of limitation in the conveyance of land. Where a person by a gift or conveyance is granted a freehold estate such as life estate and in that same gift or conveyance, an estate is given to the grantee’s heirs in fee or in tail (for example ‘to A for life, remainder to the heirs of A’), then the words ‘to his heirs’ are read as words of limitation of the estate and not words of purchase: Shelley’s Case (1581) 1 Co Rep 93b. The rule applied to freehold estates at common law but not to leasehold, it is thus inapplicable in Hong Kong. The rule is also abolished in England: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0073].
