| 释义 | 臨時保護措施 Measures which are protective only of the subject matter of an arbitration, but not protective of the personal or financial interests of the parties, nor orders which are merely ancillary to the reference, such as orders securing the production of evidence and security for costs: Kursell v Timber Operators and Contractors Ltd [1923] 2 KB 202. An order or judgement until further hearing of an action or final judgment which usually refers to injunctive relief, that is when it inhibits the doing of anything or commanding the doing or restoring of anything: American Cyanamid Co v Ethicon Ltd [1975] AC 396 (HL); Her Majesty’s A-G in and for the United Kingdom v South China Morning Post Ltd & Ors [1988] 1 HKLR 143 (CA). The UNCITRAL Model Law on International Commercial Arbitration confers jurisdiction on the courts of Hong Kong to grant interim measures of protection: Arbitration Ordinance (Cap 341) ss 13A, 13B, sch 5 art 9.
