| 释义 | 觀望規則 A rule observed in regard to property interests, future interests in property, and the rule against perpetuities. The party claiming a property interest waits to see what objections, if any, are raised to that claim. Under the rule, the validity of a disposition is tested by reference to actual as opposed to possible events. The wait and see rule is enshrined in legislation: Perpetuities and Accumulations Ordinance (Cap 257) s 8(1). The statutory provisions are not to be applied until it is established that the disposition cannot be saved merely by ‘waiting and seeing’ under s 8(1)-(3). Where the ‘wait and see’ rule applies and the period is not determined by reference to a period of years, ie a specified period not exceeding 80 years: s 6. It must be determined by reference to the lives of certain specified individuals in being and ascertainable at the commencement of the perpetuity period and is determined by reference to their lives and no others: s 8(4)(a).
