| 释义 | 合併公訴書 An indictment alleging that two or more accused persons committed the offence or offences set out in the indictment, so that the accused persons before the court are jointly charged with the offence or offences: R v Chau Wai Keung & Anor [1993] 2 HKC 332. In Hong Kong, there is no express statutory provision in Hong Kong governing the position. Generally, the accused will be joined in an indictment where there is sufficient connection between the offences alleged against them that it is in the interests of justice that they be tried jointly: DPP v Merriman [1972] 3 All ER 42, [1973] AC 584 (CCA); R v Assim [1966] 2 All ER 881, 50 Cr App Rep 224, 2 QB 249 (CCA). This is so even if the accused are alleged to have been guilty of the same crime by reason of different modes of committing the offence: R v Lee Shek Ching [1986] HKLR 304 (CA).
