Examples of non-justiciable decisions are decision involves the evaluation of social and economic policy (R v Secretary of State for the Foreign and Commonwealth Affairs, ex p Everett [1989] QB 811, 1 All ER 655 (CA)), the allocation of scarce resources among competing claims (Buttes Gas v Hammer [1982] AC 888; R v Cambridge Health Authority ex p B [1995] 2 All ER 129, 1 WLR 898; R v Inner London Education Authority, ex p Ali and Murshid [1990] 2 Admin LR 822), the exercise of a prerogative power which involved ‘a balance of competing claims on the public purse and the allocation of economic resources’ (R v CICB, ex p P [1995] 1 All ER 870), the exercising of non-statutory contractual powers (Hang Wah Chong Investment Co Ltd v A-G of HK [1981] HKLR 336, 1 WLR 1141 (PC)); Raider Ltd v S-J [2000] 2 HKLRD 300 (CFA). Apart from non-justicable decisions, the courts will not refrain from reviewing any decision.
