释义 | 可仲裁的爭議 The use of arbitration to resolve a dispute and as such it is part of the concept of ‘alternative dispute resolution’, being the settlement of conflict without resorting to litigation, eg arbitration, mediation, mini-trials, etc. Such procedures are generally viewed as more informal, less costly and often more expeditious. Hence, if a dispute can be adjudicated lawfully outside the courts and by accord and satisfaction, then it is arbitrable. Arbitration is common in complex commercial cases and labour disputes and in matters arising from construction contracts. It is generally not applicable in criminal matters (although claims arising from a criminal offence may be arbitrable): Keir v Leeman (1846) 9 QB 371.
