释义 | 無錯失法律責任 The principle that a person who has been injured by another may recover compensation from the other person, whether or not that other person was at fault (such as by negligence or recklessness). Liability flows from the event, that is, from the injury. For example, workers’ compensation legislation provides that an employer must compensate an injured employee, where the injury arises out of or in the course of employment: Employees’ Compensation Ordinance (Cap 282) s 5(1). The reasoning behind the principle is that the person liable, such as the employer, is better able to accept the risk and costs of injury, than the injured person.
