The legal right of banks to levy compound interest on their lending to customers. This right has been judicially recognised as a ‘usage of bankers’ and is implied in the banker-customer relationship. The customer’s acquiescence or implied consent is not required for the bank to exercise this right. This right continues even after the bank’s demand for payment, until the date of judgment. However, an implied contract for compound interest will come to an end if the relation of banker and customer is completely superseded by the relation of mortgagor and mortgagee. Any right to capitalise interest thereafter must be found in the mortgage: National Bank of Greece SA v Pinios Shipping Co No 1 (The Maira) [1989] 1 All ER 213, [1990] 1 AC 637 (CA); Nanyang Commerical Bank Ltd v Chan Hon Wing & Ors [1989] 1 HKC 256 (HC).
