Also derived from ‘contingent’ (or uncertain) with reference to a debt based on an existing obligation that awaits or depends upon the happening of a future event that may or may not happen; hence a contingent debtor is the antonym of contingent creditor. 2. Claims are provable in the proceedings including, inter alia, all debts and liabilities, certain or contingent: Bankruptcy Ordinance (Cap 6) s 34(3). As such, the law in bankruptcy is also applicable in company law: Companies Ordinance (Cap 32) s 264. A company’s liabilities that may under certain conditions become obligations of the company but are not direct or assumed obligations on the date of a given balance sheet. 3. A contingent debt may arise in guarantees, in which a guarantor agrees to pay the indebtedness of a debtor who defaults in payment to a creditor. The contingent liability of the guarantor is such that the guarantor only pays the debt if the debtor is unable to do so.
