释义 | 特權 The term describing a number of rules excluding evidence that would be adverse to a fundamental principle or relationship if it were disclosed. Examples of privilege include privilege against self-incrimination (Ho Sai Chu v Cheng Yun Sing [1993] 2 HKC 506; Evidence Ordinance (Cap 8) s 65(1)), and legal professional privilege (R v Mabel Lee (No 1) [1963] HKLR 791). The right to claim a privilege belongs to the person vested with the interest or relationship protected by the privilege: R v Peterborough Justices, ex p Hicks [1977] 1 WLR 1371, [1978] 1 All ER 225 (DC). However, a person or party to litigation may claim privilege on behalf of someone else in a representative capacity, for example, a lawyer acting for a client may claim legal professional privilege on behalf of the client: Great Atlantic Insurance Co v Home Insurance Co [1981] 1 WLR 529.
