释义 | 所有權欠妥 Where a person’s claim to ownership of property is deficient or imperfect. Bills of exchange - 1. The title of a person who negotiates a negotiable instrument is defective where the person has obtained the bill or its acceptance by fraud, duress, force and fear, or other unlawful means; or for an illegal consideration; or when the negotiation is in breach of faith or under such circumstances as to amount to fraud: Bills of Exchange Ordinance (Cap 19) s 29(2). 2. In relation to title to property, an irregularity indicating a want of completeness of title. See also Duress; Fraud; Holder in due course; Negotiable instrument. Real property - Where a person’s claim to ownership of property is deficient or imperfect due to a fault, error or omission in the documents or document claiming or proving title to land. The abstract of title or the chain of title may be defective in regard to land under the general law. A vendor is bound to disclose all latent defects in his title to an intending purchaser, but he will not be compelled to give an indemnity against the defects: Ridgway v Gray (1849) 1 Mac & G 109; Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0185]. Where a defect in title is removable by the vendor, the purchaser cannot repudiate the contract on the ground of non-disclosure: Poon Hoi Tin v Melot Investment Ltd [1987] 2 HKC 382; Oceanic Glory Industries Ltd v Palace Development Ltd [1990] 1 HKC 448.
