| 释义 | 撤銷遺囑認證 The cancellation of a grant of probate by the court because it was obtained by fraud or mistake. For grants in solemn form, revocation may occur in limited cases where the grant was fraudulently obtained such as the discovery of a later will or codicil after the grant or the discovery that the deceased is still alive: Birch v Birch [1902] P 130. An application for the revocation of probate must be made through the Probate Registry of the court: Probate and Administration Ordinance (Cap 10) s 24. Every person who is entitled or claims to be entitled to administer the estate of a deceased person under or by virtue of an unrevoked grant of probate of his will or letters of administration of his estate shall be made a party to any action for revocation of the grant: The Rules of High Court (Cap 4A) O 76 r 3. If revoked, the grant must be delivered to the court for cancellation before a fresh grant can issue: Probate and Administration Ordinance (Cap 10) s 24.
