释义 | 地役/奴役 A right in rem held in relation to the property of another person which involves a restriction on the right of an owner to deal with it. Conflict of laws - In international law, a restriction on the sovereignty of a state where the state is required to do or refrain from doing something on its territory: North Atlantic Coast Fisheries Arbitration (US v UK) 1910 11 RIAA 167. Servitude has not been held to include certain fishery rights, while including certain rights of passage: for example, North Atlantic Coast Fisheries Arbitration; Right of Passage over Indian Territory (Portugal v India), Merits 1960 ICJ 6. The existence of a servitude does not imply that the dominant state has acquired sovereignty over an area of the servient state; nor has the latter alienated its sovereignty in favour of the former. See also Sovereignty. Real property - An incorporeal interest in land, giving rights over the land of another short of actual possession. Servitude is a wide term which includes both easements and profits à pendre: Dalton v Angus & Co (1881) 6 App Cas 740 (HL).
