In relation to a defendant, a payment on account of any damages, debt or other sum (excluding costs) which he may be held liable to pay to or for the benefit of the plaintiff, and any reference to the plaintiff or defendant includes a reference to any person who, for the purpose of the proceedings, acts as next friend of the plaintiff or guardian of the defendant: The Rules of the High Court (Cap 4A) O 29 r 9. A payment of damages by a defendant whether voluntarily or in accordance with a court order prior to the completion of proceedings: O 29 rr 10-11. The object of such payment is to mitigate hardship or prejudice to the plaintiff during the period from the institution of proceedings up to the date of trial: Halsbury’s Laws of Hong Kong, Vol 5 [90.0810]. An interim payment is not by itself an admission or a finding of liability. Moreover, a standard practice should be adopted for applications for interim payment and no distinction should be made between personal injury cases and other types of cases, ie once the threshold in the rules of O 29 are satisfied, the Court should order interim payment as it thinks fit and there is no requirement for the plaintiff to demonstrate particular need over and above the general need for payment of damages : Sun Jianqiang v Chan Tai Kau & Anor [2001] 2 HKLRD 435 (CFI).
