| 释义 | 有缺陷的工程／不合規格的工程 In a building project, work that fails to comply with the requirements of the building contract, including any drawings or specifications, together with any implied terms as to its quality, workmanship, performance or design. A contractor would be in breach of contract in that respect, notwithstanding the fact that the contractor is not guilty of any personal fault in providing such work: Manufacturers’ Mutual Insurance Ltd v Queensland Government Railways (1968) 118 CLR 314. A contractor may be under an obligation to warn the builder and building owner of any defect or any deficiencies in the plans or specifications which might result in a defect during the works (Brunswick Construction Ltd v Nowlan (1974) 49 DLR (3d) 93, 21 BLR 27), or even after completion (Stag Line Ltd v Tyne Shiprepair Group Ltd, The Zinnia [1994] 2 Lloyd’s Rep 211).
