| 释义 | 再保險 A contract of insurance taken out by the original insurer (the reinsured) with another insurer (the reinsurer) to indemnify the reinsured against liability or payments under the original or underlying contract of insurance. For example, the insurer under a contract of marine insurance has an insurable interest in his risk, and may reinsure in respect of it: Marine Insurance Ordinance (Cap 329) s 9(1). Reinsurance may be taken out against the risk of having to pay a particular claim (facultative reinsurance) or claims related to a particular class of business (treaty insurance). The contracts of insurance and reinsurance are entirely independent of each other and, unless otherwise provided by the reinsurance contract, the original insured has no right or interest in respect of the reinsurance: Marine Insurance Ordinance (Cap 329) s 9(2). The subject matter of the reinsurance contract will be the same as that of the original insurance policy: Nelson v Express Assurance Corp Ltd [1905] 10 Com Cas 237. A policy of reinsurance, although effected after the original policy, normally attaches from the same time as the original policy: Marine Insurance Co Ltd v Grimmer [1944] 2 All ER 197 (CA). It is almost the universal practice to insert a clause, often called the ‘reinsurance clause’, to the following effect: ‘Being a reinsurance, subject to the same clauses and conditions as the original policy, and to pay as may be paid thereon’: Home Insurance Co of New York v Victoria- Montreal Fire Insurance Co [1907] AC 59 (PC).
