释义 | 補救 The means available at law or equity by which a right is enforced or the infringement of a right is prevented, redressed, or compensated. Remedies may be obtained by four different methods: by the act of the person injured (including self-defence, distress, entry, abatement, and seizure); by operation of law (as in the case of retainer and remitter); by agreement between the parties (as in the case of accord and satisfaction, and arbitration); or by judicial process (such as an action or suit). The first three categories are extra-judicial remedies, while the last are judicial remedies. Civil remedies include damages, an injunction, an order for specific performance, or a declaration. The basic common law remedy in tort actions is damages, the aim of which is to put the plaintiff, in so far as is possible, into the position he or she was in before the tort was committed: Livingstone v Rawyards Coal Co (1880) 5 App Cas 25 (HL); Keep Point Development Ltd v Chan Chi Yim & Anor [2002] 1 HKC 131.
