The shore and bed of the sea and of any tidal water within Hong Kong, below the line of the high water mark: Foreshore and Sea-bed (Reclamations) Ordinance (Cap 127) s 2. It would include reclaimed foreshore and sea-bed land (Halsbury’s Laws of Hong Kong (2001 Reissue) Vol 16, Land [230.0833]), and it forms part of the land in Hong Kong: Conveyancing and Property Ordinance (Cap 219) s 2. As at 1 July 1997, the land within Hong Kong Special Administrative Region became State property and, according to the Basic Law art 7, the Government of the Special Administrative Region is responsible for its management, use and development and for their lease or grant to individuals, legal persons or organisations for use or development: Sihombing & Wilkinson, A Student’s Guide to Hong Kong Conveyancing (1997) ch 2, p 39. The Government may bring an action for the recovery of foreshore (for example: Re Trustees of the Estate of Tsang HungTim Dec’d v Sui Heong Yuen Godown Co [1971] HKLR 68; Li Ling Shi & Ors (No 2) v The Government of Hong Kong [1964] HKLR 428) at any time before the expiration of 60 years from the date on which the right of action accrued: Limitation Ordinance (Cap 347) s 7(1).
