释义 | 定值保單 An insurance policy which specifies the agreed value of the subject matter insured: Marine Insurance Ordinance (Cap 329) s 27(2). In a valued policy the blank in the valuation clause is filled up with the sum at which the parties agree to value the subject matter insured. Unless the policy is voidable on the ground of fraud or for some other reason, the value fixed by the policy is, as between the insurer and the assured, conclusive of the value of the subject intended to be insured whether the loss is total or partial: s 27(3); Re Tai Sun Insurance & Banking Co Ltd (1920) 15 HKLR 80 (FC). The assured must give credit as against the valuation for any sum received by him under any other policy without regard to the actual value of the subject matter insured: s 32(2)(b). Where part of the goods, merchandise or other movables insured by a valued policy is totally lost, then, subject to any express provision of the policy, the measure of indemnity is such proportion of the sum fixed by the policy as the insurable value of the part lost bears to the insurable value of the whole, ascertained as in the case of an unvalued policy: s 71(a).
