| 释义 | 饋贈終止 The failure of a testamentary gift to take effect due to, for instance, the beneficiary predeceasing the testator, whether before or after the date of the will: Maybank v Brookes (1780) 1 Bro CC 84. On lapse, the failed gift will fall into the testator’s residuary estate to be distributed to the residuary beneficiaries or if the failed gift itself is residuary, it will be distributed according to the intestacy rules: Re Estate of Lau Sai Iat [1999] 2 HKC 433; Hong Kong Bank Trustee Ltd & Anor v Fu Chui Ying & Ors [1994] 1 HKC 702. In the case of a gift to a spouse, where there has been a dissolution or annulment of the marriage, the reference to ‘lapse’ in the provisions of the Wills Ordinance, means ‘fail’: Wills Ordinance (Cap 30) s 15.
