释义 | 賄賂 Bribery in a variety of different forms is an offence under the Prevention of Bribery Ordinance (Cap 201). Central to these offences is the giving and receiving of advantages. For example, the offering, accepting or soliciting of advantages to or by a public servant is an offence: Prevention of Bribery Ordinance (Cap 201) s 4; R v Ip Chiu [1977-1979] HKC 182 (PC). Further, where any person who, being or having been a prescribed officer, either maintains a standard of living or is found in control of pecuniary resources or property not commensurate with, or disproportionate to, his or her present or past official emoluments, he or she is guilty of an offence unless satisfactory explanation is given: Prevention of Bribery Ordinance (Cap 201) s 10; A-G v Hui Kin Hong [1995] 1 HKCLR 227 (CA). Corruption offences in relation to an election: R v Leung Kam Ho Gilbert [1994] 1 HKC 172 (CA).
