| 释义 | 一幅土地 A portion of piece of land all of which, generally, is amenable to the same title description. Thus, the text of a general law of deed of conveyance containing the description of the title, and identification of the land conveyed was called ‘the parcels’ and followed the testatum. A description which is sufficient without reference to a plan may be enough, but the purchaser can insist on a plan in order to supplement the general description in the assignment. The description of the parcels in the assignment should correspond with the description in the contract for sale: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0329]. Where the assignment concerns a unit in a multi-storey building, the number of the undivided shares, and any identifying features should be stated correctly and accurately: Lee Tak Chun v East Weal International Ltd [1994] 1 HKC 722; Ng Shou Chun v Hung Chun San [1994] 1 HKC 155. If there was a dispute with regard to what was actually conveyed, that was a matter of construction of the whole conveyance, including the parcel clause and the plan, in the light of other surrounding circumstances. The object was to ascertain what the parties intended to be passed under the document and what was passed: S-J v Wing Lung Wai Community [1999] 3 HKC 580. Exceptions and reservations out of the property assigned must be specifically mentioned, unless they are implied by law.
