The phrase has two meanings: 1. The plaintiff’s assets were decreased; this is the ‘primary’ or ‘subtractive’ sense of unjust enrichment involving the assertion of a remedy on the ground of unjust enrichment which ignores the wrong. 2. The defendant has benefited by reason of a wrong done to the plaintiff; for example, waiver of tort: Brocklebank Ltd v R [1925] 1 KB 52 (CA). This is the ‘secondary’ sense of unjust enrichment; the obligation to make restitution arises because of the commission of the wrong and is a form of secondary obligation: Photo Production Ltd v Securicor Transport Ltd [1980] AC 827, 1 All ER 556 (HL); Woomera Co Ltd & Anor v Provident Centre Development Ltd [1984] HKC 298 (HC), [1985] HKLR 263 (CA). This secondary meaning involves reliance on the wrong itself.
