释义 | 僱主的法律責任 The liability of an employer for acts or omissions of its employees which cause injury or damage to third parties or to fellow employees, and for the failure to protect employees from injury at work. Under the first head, an employer is vicariously liable for the negligence of servants, but not generally independent contractors (Kwan Kin Travel Services Ltd v Wong Mee Wan [1994] 1 HKC 308 (CA)), acting in the course of their employment or while the servants are engaged on their employer’s business: So Wing Kwong v Cheng Chi Kwong & Ors [1999] 4 HKC 831. Under the second head, liability arises through the employer’s non-delegable duty of care towards its employees, which entails a general duty to safeguard employees from unreasonable risk of injury while at work: Employees’ Compensation Ordinance (Cap 282) s 5; Lau Kam Nui v San Kee Co Ltd [1998] 4 HKC 612 (CA).
