释义 | 死亡導致的受挫失效 Termination of a contract on the death of a party, where the party was personally involved in the contract (for example, the involvement of an employee in a contract of employment): Taylor v Caldwell (1863) 3 B & S 826, 122 ER 309. Where the availability of a person is essential for continuation or performance of a contract, parties to the contract shall be discharged upon death of such person. Death of an employee is a ground for summary termination of an employment contract: Employment Ordinance (Cap 57) s 9(1)(b); Chak Chong Chi v Maxim’s Caterer’s Ltd (Labour Tribunal Appeal 25/1992).
