| 释义 | 共同管養權 A custodial arrangement where the custody of a child is shared between parents or applicants which might otherwise have been granted to one parent or applicant exclusively under a sole custody order by the court. This arrangement will have the effect that a child spends alternate weeks with each parent. The periods during which the child is to live in different households with one of the parents may or may not be specified. The parents of the child shall have the parental rights, powers and responsibilities in relation to the child’s custody. Such rights, powers and responsibilities were jointly exercised or borne by both parents and not in the exclusion of another parents. Where there is a reasonable prospect that the parties will co-operate the court may make a joint custody order: S(BD) v S(DJ) (infants: care and consent) [1977] 1 All ER 1123 (CA). However, the care and control of the child may be granted to one of the parents with reasonable access of the child by another parents.
